These terms and conditions apply to the temporary letting of Ferienhaus am Schlosspark, Schulstraße 5, 12683 Berlin-Biesdorf, for holiday purposes. The landlord is Ferienhaus am Schlosspark GbR, represented by Sebastian Zange and Ivonne Albers. Contact details can be found in the Legal notice.
Individual agreements take precedence over these terms.
§ 1 Formation of the contract
An enquiry through the website is non-binding and does not make a reservation or booking. After checking your requested dates, we will send you a personal offer. A contract is formed when you request a booking on the basis of that offer and we confirm it. The agreed services, travel dates, number of guests and price are set out in the offer and booking confirmation.
The contracting party is the person making the booking. The deposit is a part-payment under an already concluded contract; formation of the contract does not depend on receipt of the deposit.
§ 2 Services provided by the landlord
We make the holiday home available to you for the agreed period in the condition promised in the contract. If this is not possible, your rights are governed by the applicable statutory provisions. Alternative accommodation requires your agreement.
§ 3 Non-use of the booked stay
Section 11 applies to cancellations before arrival. If you arrive late, depart early or fail to arrive for reasons attributable to you, our payment claims are governed by statutory provisions. Saved expenses and income from re-letting are taken into account. Statutory termination and withdrawal rights remain unaffected.
§ 4 Use, number of guests and pets
The holiday home is let as a whole, with its garden, and may only be used by the number of overnight guests agreed in the booking confirmation, up to a total of eight people. Additional overnight guests, subletting or otherwise making the property available to third parties require our prior consent.
Gatherings and celebrations beyond the agreed scope of use are only permitted by prior arrangement. Pets may only be brought with our prior consent. Any surcharge is agreed before booking.
§ 5 Arrival, departure and minimum stay
The holiday home is available from 4 pm on your arrival day until 10 am on your departure day. Other times may be agreed. The minimum stay is five nights; shorter stays may be arranged on request.
Before arrival, you will receive your access code and information about the house. Check-in and check-out require no appointment.
§ 6 Prices and additional services
The total price agreed when the contract is concluded applies. Accommodation prices include statutory VAT, final cleaning and normal charges for electricity, water, wastewater, waste disposal and the broadcasting contribution. Wi-Fi is free.
Additional guests, booked linen packages and any agreed pet surcharges are charged as stated in the offer. Berlin’s statutory accommodation tax is shown separately in the price breakdown where applicable. All charges for the booked stay are disclosed before the contract is concluded. The refundable security deposit is additional and is not part of the accommodation price.
§ 7 Payment
Payment is by bank transfer to the account stated in the booking confirmation. 50% of the agreed total price is payable within 14 days of booking. The balance is due seven days before arrival. Different payment deadlines, particularly for short-notice bookings, are agreed before the contract is concluded.
§ 8 Security deposit
The security deposit is €500. A higher deposit may be agreed before the contract is concluded in justified exceptional cases, for example for longer stays. The deposit is transferred together with the balance.
After departure, we inspect the holiday home and settle the deposit within 14 days. If there are no justified claims, we refund it to your bank account. If claims still need clarification, only a reasonable amount necessary for those claims may be temporarily retained; the undisputed balance is refunded.
Deductions are explained and itemised. No compensation is charged for normal wear and tear resulting from agreed use. Extra cleaning may only be charged for soiling beyond the usual level for which the guest is responsible. Claims exceeding the security deposit are governed by statutory provisions.
§ 9 Liability
The liability of the landlord and guests is governed by statutory provisions. This applies in particular to injury to life, body or health and to damage caused by intentional or negligent breaches of duty. Statutory rights relating to defects remain unaffected.
Please report any damage you notice without delay. Whether personal liability insurance covers a loss depends on the relevant insurance policy and does not alter statutory liability.
§ 10 Care of the holiday home and defects
Please treat the holiday home and its contents with care and report defects or faults promptly so that we can remedy them. Your statutory rights in relation to defects remain unaffected.
Please leave the holiday home in a tidy condition. Normal final cleaning is included in the price.
Entry during your stay is only made for a justified reason and by prior arrangement, for example for necessary repairs. Immediate access may be required in an emergency or where there is a specific danger. There is no general right to inspect without a reason.
§ 11 Cancellation
You may cancel your booked stay before arrival. Please notify us in text form where possible, for example by email. The date we receive your cancellation determines the applicable deadline.
- Up to and including 90 days before arrival: free of charge.
- 89 to 61 days before arrival: 30% of the agreed rental price.
- 60 to 31 days before arrival: 50% of the agreed rental price.
- From 30 days before arrival until the start of the stay: 80% of the agreed rental price.
You are expressly entitled to prove that we suffered no loss or a substantially lower loss. Income from re-letting and saved expenses are taken into account insofar as they are not already included in the relevant flat-rate charge. The same loss will not be charged twice. Additional services not provided will not be charged.
Payments already made are offset against justified claims; any remaining credit is refunded within 14 days. Section 3 applies to non-arrival and early departure. Both parties’ statutory termination and withdrawal rights remain unaffected. No right for the landlord to terminate without cause is agreed.
Contracts for holiday accommodation for a fixed period generally carry no statutory right of withdrawal under section 312g(2), number 9 of the German Civil Code (BGB). The cancellation option granted above remains unaffected. Travel cancellation insurance may be advisable.
§ 12 House rules
Please observe the house rules supplied before the contract is concluded and be considerate of the neighbours. The house rules supplement these terms but do not restrict statutory rights.
Serious or repeated breaches of duty may lead to termination where the statutory requirements are met. Any required warning or deadline is governed by statutory provisions. Payment and compensation claims are calculated taking account of saved expenses and income from re-letting.
§ 13 Data protection
Personal data is processed in accordance with applicable data protection laws, particularly the General Data Protection Regulation and Germany’s Federal Data Protection Act. Information about purposes, legal bases, recipients, retention periods and your rights can be found in our privacy policy.
§ 14 Dispute resolution and jurisdiction
We do not participate in dispute resolution proceedings before a consumer arbitration body. Statutory rules on jurisdiction apply.
§ 15 Final provisions
If any provision of these terms is invalid or does not become part of the contract, the statutory consequences apply, particularly section 306 BGB. Invalid provisions are replaced by the applicable statutory provisions.
